Do the Inheritance Shares Exceed the Estate? (the Awl Problem)

The apparent mathematical conflict in inheritance shares is resolved through established Islamic jurisprudence, ensuring that all heirs receive a fair proportion of the estate.

Understanding the Quranic Verses on Inheritance

The Quran sets specific shares for heirs in verses 4:11-12. These verses provide detailed instructions on how an estate should be divided among family members, ensuring justice and fairness.

Allah instructs you concerning your children: for the male, what is equal to the share of two females. But if there are only daughters, two or more, for them is two-thirds of one's estate. If there is only one, for her is half. And for one's parents, to each one of them is a sixth of his estate if he left children. But if he had no children and the parents [alone] inherit from him, then for his mother is one-third. And if he had brothers [and/or sisters], for his mother is a sixth, after any bequest he [may have] made or debt. Your parents or your children - you know not which of them are nearest to you in benefit. [These shares are] an obligation [imposed] by Allah. Indeed, Allah is ever Knowing and Wise.

What Critics Say About the Awl Case

Critics argue that in some family configurations, the specified shares exceed the total estate, suggesting a mathematical oversight. This situation, known as "awl," can happen when the combined fractions surpass the whole.

How Islamic Jurisprudence Addresses the Issue

Islamic scholars addressed the awl situation early in Islamic history. The solution involves proportionally reducing each heir's share so that the total equals the estate. This method preserves the Quranic intent of fairness while accommodating the practicalities of division. For example, if the specified shares add up to more than the estate, each share is adjusted proportionally. This method was endorsed by prominent companions of the Prophet (PBUH), including Umar ibn al-Khattab, who applied this solution during his caliphate.

The Wisdom Behind the Solution

The adjustment for awl reflects Islam's emphasis on justice and practicality. It demonstrates the flexibility within Islamic law to address real-world situations while upholding the Quran's guidance. The awl solution ensures that no heir is disproportionately favored or disadvantaged, maintaining harmony and fairness within the family. In conclusion, the awl case illustrates the depth of Islamic jurisprudence in addressing complex issues. Rather than a flaw, it showcases the adaptability and fairness inherent in Islamic inheritance laws.
